Non-Mexican Liquor Could Be Banned

A new hard blow could hit the restaurant sector, especially those falling into the "small contributors" category, as the 4th paragraph of Art. 137 of the Income Tax Act published in the Federation's Official Daily is causing uncertainty. María del Socorro López, President of the local delegation of the Restaurants Association, will be requesting the necessary information from the fiscal authorities in order to explain the terminology more clearly.

Loosely translated, the text states that "those who dispose of foreign merchandise will not be able to pay taxes under that section." Ms. López said that the only interpretation of the text would leave restaurant owners defenceless, and they would be unable to sell liquor coming from outside the country in their establishments as that would imply a change of category for them, with all the consequences resulting from such a change.

Depending on the interpretation, the repercussions could be very serious as imported products such as whiskey, rum, gin, table wines and other foreign liquors would have to be removed from the shelves…

This would be in addition to the 60% additional tax on the sale of Tequila contemplated in the federal government's new budget that came into effect January 1st.
